About these terms

These Terms of Use are an agreement between you and Arctic Star Studio (operated by Soundarraj Sathiyamoorthi) (“Arctic Star Studio”, “we”, “us”). They cover arcticstarstudio.com and every game we publish, on every platform, including updates, downloadable content and online features (together, our “services”).

By visiting the website, or by installing, playing or buying anything in one of our games, you agree to these terms. Our Privacy Policy explains how we handle your data. If you don't agree, please don't use our services.

If you got a game from a store or platform, that store's terms apply too. Where they conflict with these terms about the store's own role, such as payments, refunds and downloads, the store's terms win.

Age and parental consent

You must be old enough to agree to these terms where you live. If you are under 18 (or the age of majority in your country), a parent or guardian must agree to them for you and is responsible for your purchases. Each game's age rating is shown on its store listing.

Your license to play

Our games are licensed, not sold. When you install one, we give you a personal, limited, non-exclusive, non-transferable and revocable license to download, install and play it on devices you own or control, for your own non-commercial entertainment. The one commercial use we allow is described under Videos and streaming.

You may not:

copy, sell, rent, sublicense or distribute our games or their content;
decompile, reverse engineer or modify them, except where the law expressly allows it despite this restriction;
remove copyright, trademark or other notices; or
distribute modified versions, unless we say a game supports mods.

We keep all rights we don't expressly give you.

Purchases and refunds

Paid games and in-app purchases are sold through the store you use. The store takes your payment, charges any taxes and handles refunds under its own policies. We never see your card or bank details.

Steam: see Steam Refunds.
itch.io: email support@arcticstarstudio.com with your order details, and we will handle the request in line with itch.io's terms.

Prices are shown in the store and may change. If a purchase doesn't arrive or goes missing, try the game's Restore purchases option where it has one, or email support@arcticstarstudio.com with the store's receipt or order ID.

Nothing in these terms takes away refund or consumer rights you have under the law where you live.

Virtual currency and items

Some games let you earn or buy virtual currency and items, such as coins, cosmetics or level unlocks. They are part of your license to play: you don't own them, and they have no cash value.

They can't be exchanged for real money, goods or anything else of value outside the game.
They can't be sold, traded or transferred, except through features a game provides.
Once delivered, purchases are final, unless the store's policy or the law says otherwise.
We may adjust how items work, for example to rebalance a game. We won't take away items you paid for without a good reason, such as fixing an error or dealing with cheating.
If a game ever sells randomized items, it will show the odds of receiving each type of item before you buy.
When your license ends, or a game's online services close, unused virtual items end too.

Some games are free to play and supported by ads from third-party networks. We choose the networks and set content filters, but we don't create the ads, and showing an ad isn't an endorsement of what it promotes. Rewarded ads are always optional. If a game sells a purchase that removes ads, the game describes which ads it removes. How ad data is handled, and your choices, are explained in our Privacy Policy.

Fair play and acceptable use

Play fair and be decent to other players. You agree not to:

use cheats, hacks, bots, automation, exploits or modified game clients, or tamper with game files, saves or network traffic;
deliberately exploit bugs (please report them to us instead);
get paid items or currency without paying, or interfere with purchases or ads;
attack, overload or disrupt our services, or try to access accounts, servers or data that aren't yours;
buy, sell or share accounts, progress or virtual items outside the game;
harass, threaten or harm other players, or impersonate anyone, including Arctic Star Studio staff;
share content that is illegal, hateful or sexually explicit, infringes someone's rights or contains malware; or
use our services in a way that breaks the law or the rules of the store you got the game from.

If you break these rules, we may remove what you gained, reset progress or items, or suspend or end your access, depending on how serious it is. Where we can, we will tell you why and give you a chance to respond.

Your content and feedback

Some games may let you create player names, messages, levels or other content, and you can always send us feedback, bug reports and ideas. You keep ownership of what you create. You give us a worldwide, non-exclusive, royalty-free license to host, store, display and adapt it as needed to run, improve and promote our services, for as long as it stays in a game (plus a reasonable time in backups after you delete it).

You are responsible for what you share and confirm you have the right to share it. We may remove content that breaks these terms.

Feedback and ideas are always welcome. Sending them is voluntary, and we may use them without paying you. We may also already be working on something similar.

Videos and streaming

Yes, you can make videos of our games, and we would love to see them. You may record, stream and upload gameplay videos, streams, guides, reviews and shorts on YouTube, Twitch, TikTok and similar platforms, and you may earn money from them through those platforms' partner programs, ads, memberships, sponsorships and tips. You don't need to ask us first.

A few simple rules:

Credit us. Name the game and the studio, for example “Game title by Arctic Star Studio”, and link to the game's page on this website or its store listing in your description.
Don't imply endorsement. Don't suggest we sponsor or endorse you unless we have agreed to it in writing, and make any disclosure the law requires, including when we gave you a free copy.
Add something of your own. Your video should include your commentary, play or editing. Don't re-upload our trailers, soundtrack or art on their own, or sell our content directly, such as on merchandise.
Respect embargoes. Don't publish unreleased content we shared with you in confidence before the agreed date.
No piracy or cheats. Don't share game files, cracked builds, cheats or keys meant for someone else.

Fan art, cosplay and fan fiction are welcome too, as long as they are non-commercial. For anything commercial, email hello@arcticstarstudio.com first.

If an automated system such as YouTube Content ID claims your video of our game, email hello@arcticstarstudio.com and we will help release it. We may withdraw this permission for content that breaks these terms or is hateful, defamatory or illegal.

Our intellectual property

Our games and website, including their code, art, music, sound, characters, story and text, and the Arctic Star Studio name and north-star logo, belong to Soundarraj Sathiyamoorthi or our licensors and are protected by copyright, trademark and other laws. Apart from the uses these terms allow, you need our written permission to use them.

Journalists and creators can use the materials in our press kit to cover and review our games. Some games include open-source software, which is licensed under its own terms and listed in that game's credits.

If you believe something in our services infringes your rights, email hello@arcticstarstudio.com with the details, and we will look into it promptly.

Third-party services

Our services work with services we don't control: app stores, platform features such as Google Play Games, Game Center and Steam, ad networks, payment processors and links to other websites. Their own terms and privacy policies apply, such as the Google Play Terms of Service and Apple's Licensed Application End User License Agreement, and we are not responsible for their content or how they work.

Updates and availability

We keep improving our games. We may update, change or remove features, content or virtual items, release updates you need to install to keep playing, or stop offering a game. Online features need an internet connection and may not be available everywhere or all the time. Before we permanently close the online services of a game you paid for or bought items in, we will give reasonable notice, at least 30 days where we can.

Disclaimers

We put a lot of care into our games, but we provide our services “as is” and “as available”. To the fullest extent the law allows, we make no promises beyond those in these terms. In particular, we don't promise that our services will be uninterrupted or error-free, that they will work on every device, or that saved data will never be lost. Nothing in these terms limits warranties or rights that can't be excluded under the law that applies to you.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, data or goodwill, arising from your use of our services. Our total liability for any claim about our services is limited to the greater of (a) what you paid us for the game or items the claim relates to in the 12 months before the claim, and (b) INR 5,000.

These limits don't apply to liability that the law doesn't allow us to limit, such as liability for death or personal injury caused by negligence, or for fraud.

Ending these terms

You can stop using our services at any time by uninstalling our games, and you can ask us to delete your data on our data deletion page.

We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or if we stop offering a service. When your access ends, your license and any virtual items end with it. Sections that by their nature should continue, such as intellectual property, disclaimers, limitation of liability and governing law, continue to apply.

Governing law and disputes

If something goes wrong, please email support@arcticstarstudio.com first. Most problems are solved quickly, and we will try to settle any dispute informally within 30 days.

These terms are governed by the laws of India. Subject to the next paragraph, the courts with jurisdiction over our registered address (shown under Contact us) have exclusive jurisdiction over any dispute arising from them or from our services.

If you live outside India as a consumer, you keep the protection of the mandatory laws of your country and may bring a claim in your local courts where those laws allow it. Consumers in India may also approach a consumer commission under the Consumer Protection Act, 2019.

If you got a game from the App Store

These terms are our license for our iOS games, and they include Apple's required terms below. Where a game has no license of its own, Apple's Standard EULA applies alongside them.

These terms are between you and us, not Apple. We, not Apple, are solely responsible for the game and its content.
Your license is limited to Apple-branded products you own or control, as allowed by the Usage Rules in the App Store Terms of Service (including Family Sharing).
We, not Apple, are responsible for maintenance and support. Apple has no obligation to provide either.
If the game fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the game, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, to the extent these terms do not exclude them.
We, not Apple, are responsible for addressing any claims by you or a third party relating to the game or your possession and use of it, including product liability claims, claims that it fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
If a third party claims the game or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as “terrorist supporting”, and that you are not on any US Government list of prohibited or restricted parties.
You must comply with any third-party terms that apply when you use the game, such as your mobile data plan.
Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.

General

These terms, together with any terms shown in a game, are the whole agreement between you and us about our services. Our Privacy Policy explains how we handle your data. If a court finds part of them unenforceable, the rest still applies. If we don't enforce a term straight away, we can still enforce it later. You can't transfer your rights under these terms. We may transfer ours to whoever takes over a game or the studio, without reducing your rights. If a translation of these terms differs from this English version, the English version applies.

Changes to these terms

We may update these terms as our games and the law change, and the date at the top shows the latest version. If a change materially affects you, we will tell you in the game or on this website before it takes effect. If you keep using our services after that, the new terms apply. If you don't agree with them, you can stop using our services.
